Terms of Service

These terms apply when you use caughtthemagic.com. By creating an account or buying credits you agree to them. Questions go to support@caughtthemagic.com.

What CaughtTheMagic doesCopy Anchor Link

CaughtTheMagic uses AI to add Santa to a photo of your room so it looks like he was caught on a home camera, and can turn that photo into a short video. Results are AI-generated images made for family fun. They are not real camera footage.

Your accountCopy Anchor Link

• You must be 18 or older to create an account.
• Keep your password safe. You are responsible for activity on your account.
• One free photo is offered per person. Creating extra accounts to get more free photos is not allowed.

What you may uploadCopy Anchor Link

• Upload only photos of rooms or places that you have the right to use.
• Do not upload photos that show people, especially children.
• Do not upload anything illegal, sexual, violent or hateful, or anything that infringes someone else's rights.

We may refuse a request, remove content or close an account that breaks these rules.

Your photos and resultsCopy Anchor Link

You keep the rights to the photos you upload. You give us permission to store and process them only to make your results, show them in your account and run the service. We do not use them for advertising or to train AI models, and we do not publish them.

Subject to these terms, you may use your results for personal, non-commercial purposes, such as showing your family or sharing them on your own social accounts. AI results can contain mistakes or odd details, and we cannot guarantee a particular look.

Credits and paymentsCopy Anchor Link

• A photo costs 1 credit and a five second video costs 4 credits. Prices are shown before you pay.
• Credits are bought as one-time packs. There is no subscription and nothing renews.
• Credits do not expire and cannot be transferred or exchanged for cash.
• Payments are processed by Stripe.

RefundsCopy Anchor Link

• Failed generations: if a photo or video fails, its credits are returned to your account automatically.
• Unused credits: within 14 days of purchase, you can ask for a refund of a pack you have not used yet by emailing support@caughtthemagic.com. If you have used part of a pack, we refund the unused share.
• Not happy with a result? Email us. We will try to help, for example with credits for another try.

When a payment is refunded, the credits it added are removed from your balance. This does not limit any rights you have under consumer protection law.

Service availabilityCopy Anchor Link

We work to keep the service running, but it may be unavailable at times, especially during the busy week before Christmas. We may change or stop features. If we close the service, we will refund unused credits.

LiabilityCopy Anchor Link

The service is provided "as is". To the extent allowed by law, we are not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the 12 months before the claim.

ChangesCopy Anchor Link

We may update these terms. We will post changes on this page and update the date above. Continuing to use the service after a change means you accept the new terms.
